The following information describes how you can use custom antibodies generated from the Pioneer™ Select service. This information is intended as an informal guide.
Bio-Rad Terms and Conditions (T&C) are available on request and define the use of custom Pioneer Select antibodies in detail. The T&C are included in a formal quotation for a custom project.

The antibody—including any part of it or any recombinant molecule derived from it—may be used for your internal research, such as in vitro studies or early pre-clinical in vivo studies in small non-human animals (e.g., rodents), without further license from Bio-Rad AbD Serotec GmbH.
Further permitted uses include in vitro diagnostics and clinical monitoring. Pioneer Select antibodies are not granted for use in the field of therapeutics without first obtaining a separate license from Bio-Rad. Pioneer Select antibodies are not allowed for resale as research use reagents in customer’s product catalogs without first obtaining a license from Bio-Rad.
Customers may share antibodies and deliverables with collaborators and contractors, and may instruct Bio-Rad to deliver antibodies directly to third parties. In such scenarios, customers must ensure the third parties’ use remains subject to the permitted use in the T&C or other agreements.
Customers may instruct Bio-Rad to accept purchase orders directly from third parties for defined clones and other project deliverables by means of a Third Party Transfer Permission form.
If the antibody or derivative of the antibody is to be used as a therapeutic candidate, a Therapeutic License is required. The license must be in place before the GLP preclinical toxicology study is initiated.
Pioneer Select generates recombinant Fab antibodies and fully human immunoglobulins in vitro, without the immunization of animals. The main product received is purified recombinant antibody.
The unique Fab antibody DNA sequence and amino acid sequence are also available to you on request (light chain, Fd chain, and tags).
Using the sequence information, you may produce the antibody at your facility, or via a third party, for your internal use. The use of the antibody, any part of the original antibody, or any other recombinant molecule derived from it remains subject to the T&C and licenses. You are responsible for obtaining any additional intellectual property rights that may be required for production and use of your antibody.
All customer-supplied antigen material or antigen material made on behalf of the customer remains the customer’s background IP.
Prior to purchasing a separate license from Bio-Rad, the IP rights in the antibodies and their sequences remain Bio-Rad background IP.
All intellectual property (IP) rights arising from your permitted uses of the antibody are owned by you. You may include the sequences of the antibodies in the claims of patents for non-therapeutic applications.
You may not patent the antibodies or include the sequences in the claims of therapeutic applications without purchasing a license for use of the antibodies in the field of therapeutics.
All uses of the antibody remain subject to the T&C.
Upon purchasing a license for use of the antibodies in the field of therapeutics, all IP for the nominated clones will be yours and the clones may be included in patents including therapeutic patents. Bio-Rad would screen the DNA sequences of future campaigns to ensure transferred clones are not included in the deliverables of those future campaigns.
Bio-Rad has the right to generate antibodies against any target for itself or for a third party, provided that these antibodies are made independently, without the use of any other customer’s background IP.
